The Superior Court of Justice of Madrid (TSJM) has ratified this Friday the health measures adopted by the Government of Isabel Diaz Ayuso, by declaring that judicial authorization is unnecessary to be able to apply them in the Community of Madrid. It will not be possible smoke in the street and terraces unless there is a safety distance and nightlife will be closed.
In his sentence, he collects Efe, the Chamber agrees with the Prosecutor's Office and estimates the appeal of the autonomous government and annuls the order of the head of the Contentious-Administrative Court number 2 of Madrid, Alfonso Villagómez, who did not ratify the regional order to apply the latest consensual measures against the coronavirus, among which was also the restriction on visits to nursing homes.
Specifically, the TSJM resolution recalls that "the health authorities of each autonomous community can agree on general preventive actions and adopt the health measures and limitations they deem appropriate when there are urgent or necessary health reasons or to control communicable diseases", and they can to do "as long as they are justified and are adapted to the ultimate goal of prevention and control of individual and collective health."
The decision of the Madrid Justice puts an end to the controversy that had been unleashed after the magistrate Villagómez annulled the smoking ban, but then said that the order was still in force. The reactions have not been long in coming, such as that of the regional vice president, Ignacio Aguado, who has regretted in a comment on Twitter that Madrid has "lost more than a week to the virus due to legal issues."
